August 18, 2008 Mayor Richard Lewis called a meeting of the Winner City Council to order at 6:30 PM August 18, 2008 at the Wells Fargo Bank basement. Councilmen attending were Meiners, Root, Farley, Sherman, and McCready; absent, Finney. Also attending were City Attorney Stan Whiting, Finance Officer Jack Day, Planning and Zoning Director Dick Kirsch, and Deputy Finance Officer Rhonda Augspurger. Motion by Meiners, second by Root to approve the minutes of the previous meeting. Motion carried. Motion by Farley, second by McCready to approve the meeting agenda. Motion carried. This being the time and place advertised for a public hearing on altering the Winner Zoning Ordinance to allow bed and breakfast operations as a conditional use within residential zones. Planning and Zoning Director Kirsch reported on the state regulations pertaining to this change. There being no person or persons representative in attendance to oppose change motion by Farley, second by Sherman to place on first reading Ordinance #783 AN ORDINANCE AMEBDING ORDINANCE #737, WINNER ZONING ORDINANCE, TO INCLUDE BED AND BREAKFAST OPERATIONS WITHIN RESIDENTIAL ZONES AS A CONDITIONAL USE. Motion carried. Motion by Meiners, second by Root to adjourn as city council and convene as Board of Adjustment. Motion carried. This being the time and place advertised for a public hearing to consider the application of Ronald and Barb Hespe for an 11 foot front yard variance request at 418 S. Madison St. and there being no person or persons representative to object, and with planning and zoning approval, motion by Farley, second by McCready to approve the variance. Motion carried. Motion by Meiners, second by Sherman to adjourn as Board of Adjustment and reconvene as City Council. Motion carried. Vicki Gronlund addressed the council regarding the progress of solving the sewer problems within the city. City Engineer Dan Britton reported to council on the smoke testing which has been completed and repairs that have been made and are in progress. Planning and Zoning Director Kirsch reported on requests for variances and requested a public hearing next council meeting for two properties within the city limits. Motion by Sherman, second by McCready to schedule a public hearing for Doyle Mathis on a 19ft front yard variance at 862 E 9th St. on Sept. 2, 2008 at 6:35pm. Motion carried. Motion by Sherman, second by Meiners to schedule a public hearing for Michael Hall for a 21 ft front yard variance at 414 S. Lincoln St. on Sept. 2, 2008 at 6:35 pm. Motion carried. City Engineer Britton reported on the construction projects within the city. The street, utility, drainage committee recommends the following: Motion by Meiners, second by Farley to approve change order #1 adjusting the contract bid item for the West 1st Sanitary Sewer and Water Main Improvements project for additional 4” PVC and 4” fittings which were not included in the original contract, increasing contract by $7,766.51 and approve payment to McCready Construction in the amount of $77,239.82. Motion carried. Motion by Farley, second by Meiners to approve pay request of $57,124.96 for Rosebud Concrete for miscellaneous concrete at the alley behind the law enforcement center, East 13th St., and Johnson St. projects. Motion carried. Police Chief Schueth reported on the activity at the Law Enforcement Center. Motion by Farley, second by Root to set a public hearing on Tuesday September 2, 2008 for an application to sell retail off-sale package liquor at Sooper Dooper 1128 E. 7th St. Motion by McCready, second by Meiners to adopt the following resolution: Motion carried. Whereas, Initiated Measure #10 would prohibit any city from paying dues to any association that lobbies: Whereas, it is far more efficient and cost effective to join together with our fellow cities through the SD Municipal League for coordinated communication with the Legislature than to have each city stand along; Whereas, the costs to the taxpayers of having each city to monitor, report, and travel to Pierre to participate in the Legislative Session would be much greater than any dues to the SD Municipal League; Whereas, coordinated communication with Legislators leads to more efficiency in the Legislative process and has saved millions of dollars in taxpayer funds; Whereas, restricting the ability of South Dakotans to support candidates and communicate with their elected public officials is a violation of their right to freedom of speech; Whereas, the measure will be challenged in court and will most likely be found to be unconstitutional, costing millions of dollars in taxpayer money; Whereas, Initiated Measure #10 does not limit State government-paid lobbyists, out-of-state lobbyists, or corporate lobbyists, but only stifles coordinated voices for local control; Whereas, the City of Winner finds that municipal officials throughout South Dakota are dedicated, honest and ethical people with the best interests of their cities in mind and that cities take great pride in providing open, honest government to our citizens; Whereas, the thousands and thousands of South Dakotans who do business with the State, Cities, Counties, and other governmental entities should not be penalized for providing such services; Whereas, civic groups who work to better their community, and often require local funding to provide their services should not be prohibited from communicating their needs to local public servants; Whereas, the forces supporting Initiated Measure #10 will not reveal the source of their funding, leaving the reasonable assumption that out of state special interests are once again attempting to hijack the South Dakota ballot and abuse our initiative process; Therefore let it be resolved that the City of Winner strongly opposed Initiated Measure #10 and urges the citizens of South Dakota to vote “NO” on the measure. Motion by Sherman, second by Root to end the probation period for Corrections Officer Lee Peneaux and advance to Grade 7 Step B to $11.39 per hour. Motion carried. Motion by Root, second by Sherman to hire Sharon Wolmendorf as communications officer at Grade 7 Step A at $11.12 per hour, with 6 months probation period and full benefits. Motion carried.
